LATE, MISSING AND DAMAGED GOODS

Our charges for renting garments are calculated for the rental period. When you place your order, you will be advised of the total rental charges payable based on the information you provided. Each time you make a change to your order in accordance with these Terms and Conditions, we will inform you of the updated rental charges.

The rental charges include VAT.

If a rental garment is not returned for any reason or is damaged beyond repair, you will be charged in accordance with the following replacement charges:

If you return your order late, a late fee of £15 per day, per order, will be charged for the first 5 days that the items are late. After this 5-day period, the full replacement cost per item, as set out above, will be owed. If you are unable to comply with the return requirements, please contact us, and we will do our best to work with you.

STANDARD TERMS AND CONDITIONS OF HIRE

These Terms and Conditions of Hire govern the relationship between you and us. Please do not place an order unless you agree to be bound by these Terms and Conditions.

WHAT WE WILL PROVIDE:

HIRE OF GARMENTS

We will hire to you the garments detailed on your order form, provided they are available in your requested size. Please note that alterations cannot be made to garments as if they were purchased.

All garments are quality-checked and processed after each hire, and we make every effort to ensure they meet a high standard. However, due to dry-cleaning, there may be slight shading differences, especially when garments are ordered for a large group (e.g., a wedding party). We reserve the right to substitute to the nearest half-size as follows:

Jacket size +2 inch

Jacket length + or – 1 inch

Trouser Length + or – 1 inch

Trouser waist +2 inch

Top hat size +1/8

Shirt collar +1/2 inch

 

WHAT WE EXPECT OF YOU:

BOOKING

The hire period begins upon collection of the suits. Generally, these are available within 1-7 days before your function depending on your agreed hire. If hires are required outside the standard delivery and return dates, an additional charge of £10 per day is payable.

DEPOSIT

A deposit of £50 per wearer is due upon placing the order. The outstanding balance must be paid 30 days before the function date.

FITTING APPOINTMENTS & TRY ONS

You must try on all garments upon delivery / at fitting appointment to ensure they fit. Collection only is an option, but if the fit is not satisfactory, you must report it to us immediately or no later than 12 noon the day after collection and whilst allowing 48 hours prior to the event. You can call us at 01484 810294 during working hours to report any fit issues. If you do not report a fitting issue within this time, we cannot guarantee replacement garments will arrive in time for your function date. If replacement items are provided, additional charges may apply, which you will be responsible for.

We will not be responsible for any costs, such as travel expenses or lost work time, incurred during this fitting process.

CANCELLATION OF ORDER

If you need to cancel your order, please email [email protected]. Please see the below dates;

  • 30 days or less – We will keep the full individual order value
  • 31 to 60 days – We will keep the deposit of the cancelled individual order
  • 61 days or more – You get a full refund of your deposit, minus £50 per individual order

In certain circumstances we may need to cancel an order before it has been collected by the user.

GROUP BOOKINGS

As the person placing the order, if you are hiring garments for a group, you are responsible for ensuring all group members comply with these Terms and Conditions. You will indemnify us for any costs, expenses, losses, or damages resulting from any member of your party failing to comply with these Terms and Conditions.

DELIVERY OF GARMENTS

Any delivery time or date given by us is an estimate only. We are not responsible for delays outside our control. Garments must be tried on upon delivery to ensure a proper fit.

The total hire charge must be paid 30 days prior to the function date. Outfits will not be available for collection until all payments are made in full, sizes for all garments are obtained, and collection details are provided.

EXTENDED HIRE – (BEFORE OR AFTER THE FUNCTION DATE)

Hire orders may be extended for additional days at a rate of £15 per outfit per day.

LATE ORDERS

Late orders are those placed less than 15 days before the function date. We may accept late orders at our discretion, but we cannot guarantee that garments will be available in time for your function.

RETURN OF GARMENTS

You are responsible for the safe return of all hired garments in undamaged condition. You will indemnify us against any loss or damage to the garments during the hire period and for failure to return any garment bags or hat boxes. Garments should be returned on the specified date in the provided suit bag and box. If garments are not returned, we will pursue the return of the items and payment of all outstanding charges.

CARE OF GARMENTS

Please treat the garments with reasonable care.

Please take particular care with top hats. Under no circumstances should they be thrown in the air.

PEACE OF MIND WAIVER FEE

Payment of the Peace of Mind Waiver Fee covers accidental damage to any garments, provided the garments are used appropriately (top hats are not covered). This fee does not cover lost or stolen garments, or damage caused by inappropriate or malicious use. Personal insurance typically does not cover garments owned by us.

We reserve the right to charge for and hold you responsible for the replacement cost of any lost, stolen, or returned damaged garments (unless covered by the Peace of Mind Waiver Fee). A full list of charges is available upon request.

LIMITATION OF LIABILITY

We will not be liable for any loss of profits or indirect or consequential losses. Our liability is limited to the full hire cost of the order in connection with any claim or potential claim.

VAT

All product prices shown on the website are inclusive of any applicable UK VAT.

VAT receipts for online purchases

For purchases from www.jacobbrian.com, please quote your order number and send your request to: Jacob Brian Ltd, The Old Dye Works, Birkhouse Lane, Huddersfield HD1 4SF (or email to [email protected]). Any VAT receipts will be made out to the bill-to name and address used when the order was placed.
